Bargain Host provides World Wide Web page hosting. Bargain Host reserves the right to suspend or cancel a customer’s access to any or all services provided by Bargain Host when Bargain Host decides that the account has been inappropriately used or otherwise.
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner’s web site. Exceptions to this include ad banners, classified ads, and personal ads.
Bargain Host reserves the right to refuse service and /or access to its servers to anyone.
Bargain Host do not allow any of the following content to be stored on its servers:
Restricted Scripts – We will suspend any accounts found to be using popular bulletin boards such as yabb.cgi, ikonboard.cgi. Due to heavy resource usage by these scripts we will not allow them on our servers, you must use the bulletin board scripts provided with your hosting account.
Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material – Includes all pornography, erotic images, or otherwise lewd or obscene content.
File Sharing – BargainHost do not allow our hosting services to be used for file sharing purposes and any account found abusing our services will be terminated immidiately.
Backup Storage – BargainHost do not allow our hosting services to be used for storing backups.
Warez – Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide “links to” or “how to” information about such material.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth, diskspace, MySQL databases and/or processor utilization.
Bargain Host may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available Bargain Host reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.
All accounts are set up on a prepay basis. Although Bargain Host reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due yearly following the date the account was established, you will not be charged again after this period unless you wish to continue using our services, an email reminder will be sent out 30 days before payments are due.
Invoices will be sent directly to customers via email shortly after the online purchase has been made.
In order to streamline our accounting procedures and keep costs down Bargain Host runs a limited number of payment options.
Bargain Host accepts all major Credit Cards including Mastercard, Visa, Discover, Switch & Solo. We also accept payments via PayPal, Bitcoin and Bank Transfer.

DOMAIN NAME REGISTRATIONS
Domain names will be registered automatically on receipt of cleared payments and will be registered in the owners name. If you have made a spelling error during registration there is no refunds on domain name, but we can normally rectify any miss-spelled domains within 3 days of notice (UK domains only). Free domain names are available on new hosting plans only (must be 1 year contract or higher).
Domain name renewals: Once renewals are due you will be charged the usual domain name renewal fee as listed in our renewals price list. You will be billed automatically for domain name renewals unless you cancel domain registrations manually via the ‘client area‘.
Domain name transfers away: We do not charge any fees to transfer domain names away from our Company.
The Company will consider all requests for domain name registration and accept or reject them in accordance with guidelines set by the relevant naming authorities. In addition to our terms and conditions as set out here, you must also agree to be bound by the terms and conditions of the registries we use to secure your domain name, specifically:

You also agree that any dispute arising from your domain registration will be bound by the appropriate dispute resolution policy, specifically:

In addition, you agree to indemnify us for all costs resulting from any such dispute. The contract for registration and transfer of domain names is between the Customer and the appropriate naming authority above, and you acknowledge that the Company acts as an agent for the Customer.
i. Upon acceptance of registration requests, the Company will submit names for registration and make full registration upon receipt of payment
ii. Once a domain name has been registered no refunds will be made by the Company.
iii. The Company reserve the right to halt the registration or transfer/release of a domain name if outstanding monies are owed to them by the Customer.
iv. The Company processes domain registration requests on a first come, first served basis. Until the Customer receives confirmation of registration from the Company there is no guarantee that the domain name requested has been registered.
v. The Company may cancel or halt domain name registrations solely at its own discretion.
vi. The Company does not accept any responsibility for the use of registered domain names, including where there may be conflict over rights to ownership. The Customer agrees that it shall defend, indemnify, save and hold the Company harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against the Company, its agents, its Customers, officers and employees, that may arise or result from a domain registration provided or performed or agreed to be performed on behalf of the Customer
vii. The Customer agrees that all details submitted in respect of a domain name registration are true and correct, and holds the Company harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against the Company, its agents, its Customers, officers and employees, that may arise or result from such details submitted by the customer. The Customer acknowledges that contact information submitted in respect of domain registration will be visible on the internet (e.g. under a ‘WHOIS’ search).
viii. The Customer acknowledges that in the event of a domain registration or other dispute, the Customer must be able to demonstrate that the registration of a domain name and it’s use (directly or indirectly) does not infringe the legal rights of any third party.
ix. The Customer agrees to indemnify the Company from any legal proceedings and costs that arise as a result of the registration/non-registration of a domain name. The Customer acknowledges that a registration can only be deemed to be successful once shown under a WHOIS lookup using the system provided by the relevant naming authority, and not at any time before.
x. Data submitted by the Customer pertaining to the registration of a domain name will not be made available to other organisations and members of the public, save for that data made public by the relevant naming authority.
xi. The Company reserves the right to make alterations to the terms and conditions of domain name registration at any time.
xii. Transfers and renewals of domain names will be made under the Company terms and conditions of domain name registration in force at the time. The Company will not guarantee to notify the Customer in the event of a failure of any transfer or renewal. The Customer acknowledges that it is their liability to ensure the transfer has completed by contacting the releasing registrar 7 days after the transfer application was made.
xiii. Should the Company cease trading, domain renewals must be carried out through the relevant naming authority and all active services must be transferred to a new provider. The Company will endeavour to provide reasonable access to the Customer for the purposes of web site data retrieval, for a reasonable period after cessation of trade, such period being notified to the Customer by e-mail as soon as practicable.
xiv. The Customer acknowledges that renewal of domains is the sole responsibility of the Customer. The Customer acknowledges that the Company will not be held responsible for any losses arising directly or indirectly as a result.
CANCELLATION AND REFUNDS
Bargain Host reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership less domain registration costs. In the event of Bargain Host terminating a customers account due to a situation beyond Bargain Host’s control, the customer is not entitled to a refund. In this event Bargain Host will attempt to offer an alternative service at Bargain Host’s own sole discretion. Bargain Host’s does not guaranteed that an alternative service will be offered or be available to the customer.
If a customer contravenes Bargain Host’ terms of service a refund will not be issued in the event of a cancellation by Bargain Host and/or the customer.
Customers may cancel their account at any time. Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund if the Customer cancels the account prior to the renewal date. In addition accounts that incur domain name registration fees are also non-refundable.
We do not offer refunds on Dedicated Servers or Domain Name registrations.
Customer agrees that it shall defend, indemnify, save and hold Bargain Host harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Bargain Host, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Bargain Host against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Bargain Host’ server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Bargain Host’s server; (5) any Domain Names that expire without the Customer’s knowledge due to non-renewal.
Bargain Host will not be responsible for any damages your business may suffer. Bargain Host makes no warranties of any kind, expressed or implied for services we provide. Bargain Host disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Bargain Host and its employees. Bargain Host reserves the right to revise its policies at any time.
Any illegal activity, including adult content, links to adult content web sites, spamming or hacking will result in your site being shut down and all your files deleted without warning.
BargainHost defines spam as any type of unsolicited commercial email (UCE) or unsolicited bulk email (UBE) for any purpose. This includes, but is not limited to, the following items:
Using a non-existent return email address when sending commercial solicitations.
Mail-bombing (sending numerous messages to the same user).
Subscribing someone else to a mailing list without that person’s permission.
Posting the same article to multiple off-topic newsgroups.
Sending, being involved in sending, or employing a third party to send mail which advertises or mentions a site hosted at BargainHost to users that have not specifically requested this mail.
Any kind of forged header information.
Lists which include “harvested” addresses.
” Targeted” email lists.
Using a script on your site to send bulk or unsolicited e-mail.
Using an autoresponder at your site to send bulk or unsolicited e-mail.
Sending mail to users who have not specifically requested to receive such mail, including opt-out mailing lists.
Distributing or advertising software designed to aid in the delivery of UCE.
Please note that this includes all domain names, IP addresses, and e-mail addresses at a site. Any of the above items would be considered a violation of our policy.
Sending unsolicited commercial email may be acceptable under the circumstances outlined below:
You should have a prior relationship with the person receiving the email, and they should be aware that they will be receiving email from your domain.
If you have a subscription list, there should be a confirmation email sent to the address before that address is added.
There should always be a way to quickly and easily unsubscribe from the list included in each email, and all unsubscription requests should be quickly honored.
A valid “From:” and “Reply to” address must be included with each message.
If a client is found in violation of the above no-spam policy, the offending account may be terminated without notice, and no refund will be issued. In the event that BargainHost at any time reasonably believes that the Customer is in breach of any of the terms and conditions or is using BargainHost services in an unacceptable manner, BargainHost may immediately terminate their account without liability. At the time of termination, the Customer shall be responsible for the entire amount of the most recent statement and any excess usage charges at the time of termination.
Please contact our Abuse Department to report spam by a BargainHost customer, or for other questions regarding this policy. When reporting spam, please include the full headers of the email messages that you are making a complaint about. The information in the headers of email messages is important in confirming the origin of the offending email.
BargainHost reserves the right to make amendments or changes to this policy.

SCOPE OF TECHNICAL SUPPORT
1. Support services are provided at the sole discretion of the Company.
2. The Company provides support through its online ticket system, and by email directly to firstname.lastname@example.org
3. We do not offer support for 3rd party installations, coding, programming or site creation or design of any type.
4. Support is provided on a ‘best effort’ basis, and the Company endeavours to respond to all new support requests within 60 minutes, 24 hours a day.
